Public access to state and local government records is governed by Massachusetts Public Records Law, located at G.L. c. 66, §10, et seq. The Freedom of Information Act is a federal law that pertains to the access of federal government records.
The Public Records Law only applies to government records already in existence. A records custodian is not required by the Public Records Law to answer questions or create a record in response to a request, but may do so at his or her discretion.
A full definition of what constitutes a public record may be found at G.L. c. 4, §7(26). Most documents regardless of form are considered public records. However, information within those records may fall under a prohibition or exemption and subject that record to withholding or redaction.
